SYNOPSIS
Urges Toyota Motor Sales, U.S.A., Inc. to utilize existing commerce within Port Newark regarding recent safety recalls to ensure the most effective coordination and completion of recall activities.

A Senate Resolution urging Toyota Motor Sales, U.S.A., Inc. to utilize existing commerce within Port Newark regarding recent safety recalls.
Whereas, Toyota Motor Sales, U.S.A., Inc. (hereafter "Toyota"), on September 29, 2009, announced a safety recall of over 4 million Toyota- and Lexus-brand vehicles concerning potential floor mat interference with the accelerator pedal in such vehicles; and
Whereas, Toyota, on January 21, 2010, announced another safety recall involving over 2 million Toyota-brand cars and trucks, many of which are subject to the previous September 2009 recall, and which concerns mechanical issues that may cause the accelerator pedal to stick, including an accelerator pedal that is hard to depress, slow to return, or not smooth during vehicle operation; and
Whereas, Toyota, on February 8, 2010, announced a third recall related to braking and acceleration issues, this one involving nearly 150,000 Toyota- and Lexus-brand hybrid vehicles and focusing on anti-lock brake system computer software which may result in a delayed reaction when the brake pedal is depressed; and
Whereas, These major recalls indicate the necessity to take swift and comprehensive corrective action, not only for the safety and peace of mind of affected Toyota and Lexus vehicle owners, but for all drivers who share the roadways of this State and elsewhere; and
Whereas, Toyota makes extensive use of Port Newark, which provides it and other automotive importers with immediate access to more than 18 million consumers, and, through the port's highway network and intermodal connections to inland markets, one-day access to over 75 million consumers from Maine to Virginia and two-day access as far away as Chicago; and
Whereas, Port Newark hosts a variety of services used by Toyota concerning its automotive import activities, including inspection and quality assurance, accessorization and modification, mechanical campaigns, and fleet reconditioning, as well as origination and coordination of inland distribution of processed vehicles to dealerships; and
Whereas, Given the existing relationship between Toyota and Port Newark, and the scope of automotive services provided to Toyota through the existing commerce at Port Newark, Toyota should be encouraged to utilize this existing commerce with respect to any recall activities in order to ensure that such recall activities are coordinated and completed in the most timely and safe manner; now, therefore,
Be It Resolved by the Senate of the State of New Jersey:
1. This House respectfully urges Toyota Motor Sales, U.S.A., Inc. to utilize existing commerce within Port Newark regarding the recent safety recalls between September 2009 and February 2010, in order to help ensure that any recall activities are well coordinated and completed in the most timely and safe manner, for the benefit of affected Toyota and Lexus vehicle owners and the driving public at large.
2. Duly authenticated copies of this resolution, signed by the President of the Senate and attested by the Secretary thereof, shall be transmitted to the chief executive officer of Toyota Motor Sales, U.S.A., Inc., the Governor, the Mayor of the City of Newark and to every member of Congress elected from this State.
STATEMENT
This resolution urges Toyota Motor Sales, U.S.A., Inc. ("Toyota") to utilize existing commerce within Port Newark regarding recent safety recalls to ensure the most effective coordination and completion of any recall activities.
Between September 2009 and February 2010, there have been three major recalls announced by Toyota concerning braking and acceleration issues with millions of Toyota- and Lexus-brand vehicles. These recalls necessitate swift and comprehensive corrective action.
Given the existing relationship between Toyota and its import activities at Port Newark, and the scope of automotive services provided to Toyota through the existing commerce at Port Newark, Toyota should be encouraged to utilize this existing commerce with respect to any recall activities. Such utilization of existing commerce will help ensure that any recall activities are well coordinated and completed in the most timely and safe manner, for the benefit of affected Toyota and Lexus vehicle owners and the driving public at large.
