     Overrides Governor's line-item veto reducing Fiscal Year 2012 appropriation for Work First New Jersey - Child Care.

A Concurrent Resolution overriding a line-item veto of a Fiscal Year 2012 appropriation for Work First New Jersey - Child Care in the Department of Human Services.

 

     Be It Resolved by the Senate of the State of New Jersey (the General Assembly concurring):

 

     1.    That the following line-item of appropriation, on pages 119 and 120 of Senate Bill No. 4000 of 2011 (P.L.2011, c.85) which was the subject of objection by the Governor in the Governor's veto statement of June 30, 2011, be restored to law as follows, the objections thereto of the Governor notwithstanding:

Notwithstanding the provisions of any law or regulation to the contrary, no funds hereinabove appropriated for before‑school, after‑school, and summer "wrap around" child care shall be expended except in accordance with the following condition:  Effective September 1, 2010, families with incomes between 101% and 250% of the federal poverty level who reside in districts who received Preschool Expansion Aid or Education Opportunity Aid in the 2007‑2008 school year shall be subject to a copayment for "wrap around" child care, based upon a schedule approved by the Department of Human Services and published in the New Jersey Register, and effective September 1, 2010, families who reside in districts who received Preschool Expansion Aid or Education Opportunity Aid in the 2007‑2008 school year must meet the eligibility requirements under the New Jersey Cares for Kids child care program (N.J.A.C.10:15‑5.1 et seq.) in order to receive free or subsidized "wrap around" child care, except that families enrolled for "wrap around" child care will be exempt from the work requirement and the revised income eligibility criteria. 

 

2.         BE IT FURTHER RESOLVED, that copies of this resolution be delivered to the Governor, the State Treasurer, and the Commissioner of Human Services.


STATEMENT

 

     This resolution restores the $6.0 million appropriation in the Fiscal Year (FY) 2012 appropriations act that defrays the costs to the State of exempting families enrolled in "wrap around" child care programs under Work First New Jersey from the minimum 25-hour per week work requirement and from the revised income eligibility criteria.  The Legislature added the $6.0 million to the FY 2012 appropriations act, which the Governor subsequently cut by force of a line-item veto. 

     Absent this resolution, Work First New Jersey families who do not meet the minimum work requirement or the revised income eligibility criteria would not be eligible for free or subsidized before-school, after-school, and summer "wrap around" child care services under Work First New Jersey, the State's version of the federal Temporary Assistance for Needy Families (TANF) program.
