An Act requiring notification of Selective Service System registration requirements and supplementing Title 39 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The chief administrator shall provide in the manner set forth in this act information concerning the requirement that male citizens of the United States and immigrants under 26 years of age register with the Selective Service System in compliance with the requirements of the "Military Selective Service Act," 50 U.S.C. App. 453.  Information also shall be provided concerning the penalties that may be imposed upon eligible males who do not comply with the registration requirement.  The chief administrator shall provide the information in a manner designed to most effectively communicate the requirement to males required to register including, but not limited to, publishing the information in the driver's manual and on the commission's website.

 

     2.    This act shall take effect on the first day of the third month after enactment.

 

 

STATEMENT

 

     This bill requires the Chief Administrator of the Motor Vehicle Commission to provide information concerning the Selective Service System registration requirement for males under age 26, including applicable penalties for violators.  The bill requires the chief administrator to provide the information in a manner designed to most effectively communicate the requirement to males required to register including, but not limited to, publishing the information in the driver's manual and on the commission's website.

     While there currently is no military draft and none is anticipated, a male citizen of the United States or immigrant is required to register with the Selective Service System within 30 days of his 18th birthday. Failure to register is punishable by a fine of up to $250,000, imprisonment for up to five years, or both.  In addition, violators may be precluded from obtaining student financial aid, job training, government employment, and U.S. naturalization.  Once a young man reaches age 26 and has not registered, he is barred from receiving these benefits unless he can prove the failure to register was not knowing and willful.

     The purpose of this bill is to protect young men by ensuring that they are aware of the requirement to register, the penalties that they are subject to for failure to do so, and the benefits that they may be precluded from if the registration requirement is not fulfilled.
