      Requires annual review of law enforcement officers' motor vehicle records.

An Act concerning motor vehicle records of law enforcement officers and supplementing Title 40A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Every State, county, county park, and municipal police department or force, and every educational institution which appoints police officers pursuant to P.L.1970, c.211 (C.18A:6-4.2 et seq.) shall review on an annual basis the motor vehicle record of each law enforcement officer employed by the department, force, or educational institution. A record of the annual review conducted pursuant to the provisions of this section shall be prepared and retained by the department, force, or educational institution in accordance with guidelines promulgated under this act.

     b.    For the purposes of this section, "law enforcement officer" means a person whose public duties include the power to act as an officer for the detection, apprehension, arrest, and conviction of offenders against the laws of this State.

     c.    The Attorney General shall promulgate guidelines necessary to effectuate the provisions of this act.

 

     2.    This act shall take effect on the first day of the fourth month next following enactment, except the Attorney General may take any anticipatory administrative action in advance as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill provides for the annual review of the driving record of each law enforcement officer in the State.

     Under the provisions of the bill, every State, county, county park, and municipal police department or force, and every educational institution which appoints police officers will be required to annually review the motor vehicle record of each law enforcement officer employed by the department, force, or educational institution. Records of the annual reviews conducted pursuant to the provisions of the bill will be prepared and retained in accordance with regulations promulgated by the Attorney General.
