SYNOPSIS

     Prohibits restrictions or requirements concerning control or ownership of dogs based solely on breed or size.

An Act concerning the control and ownership of certain dogs and supplementing P.L.1989, c.307 (C.4:19-17 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  In addition to the provisions of section 21 of P.L.1989, c.307 (C.4:19-36), and notwithstanding any other law or rule or regulation adopted pursuant thereto to the contrary, no restriction or requirement concerning the control or ownership of a dog may be imposed by the State, or by any municipality, county, or county or local board of health, solely on the basis of a dog's breed or size.  The provisions of this section shall supersede any law, ordinance, or regulation to the contrary, which is enacted by any municipality, county, or county or local board of health. 

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     Existing law, at section 21 of P.L.1989, c.307 (C.4:19-36), provides that the State's vicious and potentially dangerous dogs law, at P.L.1989, c.307 (C.4:19-17 et seq.), will supersede any law, ordinance, or regulation concerning vicious or potentially dangerous dogs, any specific breed of dog, or any other type of dog inconsistent with that law enacted by any municipality, county, or county or local board of health.

     This bill would further provide that, in addition to the provisions of section 21 of P.L.1989, c.307 (C.4:19-36), and notwithstanding any other law or rule or regulation adopted pursuant thereto to the contrary, no restriction or requirement concerning the control or ownership of a dog may be imposed by the State, or by any municipality, county, or county or local board of health, solely on the basis of a dog's breed or size.  The bill's provisions would supersede any law, ordinance, or regulation to the contrary, which is enacted by any municipality, county, or county or local board of health.
