     Eliminates post-employment restriction for members and employees of New Jersey Racing Commission.

An Act concerning post-employment restrictions applicable to members and employees of the New Jersey Racing Commission and repealing sections 1 and 2 of P.L.2003, c.151.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Sections 1 and 2 of P.L.2003, c.151 (C.5:5-25.1 and C.5:5-25.2, respectively) are repealed.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     Under current law, members and employees of the New Jersey Racing Commission are prohibited from holding any direct or indirect interest in, or employment with, any applicant for or holder of a permit or license issued by the commission for a period of two years immediately following termination of membership or employment.  During the two-year post-employment period, commission members and employees are also prohibited from representing any person or party other than the State before or against the commission with respect to any matter that was before the commission during the tenure of the member or employee.  Secretarial or clerical employees of the commission are not subject to the post-employment restrictions.

     Current law also provides that an applicant for or holder of a permit or license issued by the commission must not employ or offer to employ, or provide, transfer or sell, or offer to provide, transfer or sell, any interest, direct or indirect, in any holder of a permit or license issued by the commission to a former member or employee of the commission restricted from such employment or interest.

     This bill would repeal these provisions in current law, thereby eliminating the post-employment restrictions applicable to commission members or employees.
