SYNOPSIS
Permits school districts to request and receive motor vehicle records to verify a student's eligibility for enrollment in a school district.

An Act concerning eligibility for enrollment in a school district and supplementing chapter 38 of Title 18A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. A school district may request from the Motor Vehicle Commission a motor vehicle record including personal information, for use in verifying a student's eligibility for enrollment in the school district.
b. The Motor Vehicle Commission shall disclose to a school district the information requested pursuant to subsection a. of this section in accordance with the provisions of section 2 of P.L.1997, c.188 (C.39:2-3.4).
c. As used in this section:
"Motor vehicle record" means motor vehicle record as defined in section 1 of P.L.1997, c.188 (C.39:2-3.3).
"Personal information" means personal information as defined in section 1 of P.L.1997, c.188 (C.39:2-3.3).
2. This act shall take effect immediately.
STATEMENT
This bill would permit school districts to request from the Motor Vehicle Commission a motor vehicle record including personal information for use in verifying a student's eligibility for enrollment in the school district. Under the provisions of the bill the Motor Vehicle Commission is authorized to disclose the information to the school district in accordance with section 2 of P.L.1997, c.188 (C.39:2-3.4), which implemented the federal "Drivers' Privacy Protection Act of 1994," Pub.L.103-322.
Pursuant to section 1 of P.L.1997, c.188 (C.39:2-3.3) a "motor vehicle record" is defined as "any record that pertains to a motor vehicle operator's permit, driver's license, motor vehicle title, motor vehicle registration, or identification card issued by the Division of Motor Vehicles." "Personal information" is defined in that section of law as "information that identifies an individual, including an individual's photograph; social security number; driver identification number; name; address other than the five-digit zip code; telephone number; and medical or disability information, but does not include information on vehicular accidents, driving violations, and driver's status."
