SYNOPSIS

     Provides one-time reduction of pension contribution of local public employer of employee who retires with pension reduced for dishonorable service in amount equivalent to certain previous contributions by that employer.

An Act concerning the pension system contribution of a local public employer of an employee whose retirement benefit is reduced due to dishonorable service and supplementing Title 43 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    If a member of a State-administered pension fund or retirement system whose last employer is an employer other than the State applies for a retirement allowance and the board of trustees of the pension fund or retirement system orders the forfeiture of all or part of the earned service credit or pension or retirement benefit of the member for misconduct occurring during the member's public service which renders the member's service or part thereof dishonorable pursuant to subsection c. of section 1 of P.L.1995, c.408 (C.43:1-3) or to implement any pension forfeiture ordered by a court pursuant to section 2 of P.L.2007, c.49 (C.43:1-3.1), for payments due in the State fiscal year next following such order of the board of trustees, the State Treasurer shall reduce the accrued liability contribution payable by the member's last employer by the amount certified by the pension fund or retirement system, in which the person participated and which covered the office, position or employment involved in the dishonorable service or relevant offense, as equivalent to that employer's contributions on behalf of that member for any time during which the member did not render honorable service, or committed the relevant offense.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that if a member of a State-administered pension fund or retirement system whose last employer is a local public employer applies for a retirement allowance and the board of trustees of the fund or system orders the forfeiture of all or part of the earned service credit or pension of the member for misconduct  which renders some or all of the member's service dishonorable pursuant to N.J.S.A.43:1-3 or to implement a pension forfeiture ordered by a court pursuant to N.J.S.A.43:1-3.1, then, for payments due in the State fiscal year next following such order of the board of trustees, the State Treasurer will reduce the accrued liability contribution payable by the member's last employer by an amount equivalent to that employer's contributions to the fund or system on behalf of that member for any time during which the member did not render honorable service or committed the relevant offense.
