     Concerns proof of workers' compensation coverage with certain legally required annual reports of employers.

An Act concerning proof of workers' compensation coverage for certain employers and amending P.L.2008, c.95.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Section 1 of P.L.2008, c.95 (C.34:15-79.1) is amended to read as follows:

     1.    a.  Every corporation, limited partnership, limited liability company, limited liability partnership or other employer required by law to submit an annual report to the State Treasurer, shall also [include] provide valid proof of workers' compensation coverage, if applicable, [as part of the annual report.  Without the inclusion of the valid proof of coverage, the annual report is not complete for purposes of filing, the requirement to submit the annual report is not fulfilled, and all requirements concerning the failure to submit the annual report shall apply] in accordance with any rules and regulations for reporting promulgated by the State Treasurer pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.).

     b.    For the purposes of this section, valid proof of current workers' compensation coverage shall be in the form of:

     (1)   Documentation of a current order from the Commissioner of Banking and Insurance authorizing the employer to be a self-insured employer pursuant to R.S.34:15-77; or

     (2)   A letter from an insurance carrier or verification from the employer which includes the name of the carrier, insurance policy number and date of commencement of coverage under the policy.

     2.    This act shall take effect on the 180th day following enactment.

 

 

STATEMENT

 

     This bill requires every corporation, limited partnership, limited liability company, limited liability partnership or other employer required by law to submit an annual report to the State Treasurer, to provide proof of workers' compensation coverage in accordance with rules and regulations for reporting promulgated by the State Treasurer. The bill also eliminates the provision of current law punishing failure to include proof of workers' compensation coverage.

     Under currant law, every corporation, limited partnership, limited liability company, limited liability partnership or other employer is required to include a valid proof of workers' compensation coverage as part of its annual report. The current statute also provides that without inclusion of proof of workers' compensation coverage the annual report is not complete for purposes of filing, the requirement to submit the annual report is not fulfilled, and all requirements concerning the failure to submit the annual report will apply.

     This bill provides that employers required by law to submit an annual report will provide proof of workers' compensation coverage in accordance with rules and regulations promulgated by the State Treasurer, and eliminates the current punishment for failure to include proof of workers' compensation coverage when submitting an annual report.
