SYNOPSIS

     Requires public and nonpublic schools, municipal and county recreation departments, youth serving organizations, and youth camps to utilize Preparticipation Physical Evaluation Form developed by certain medical professionals prior to child participation in athletics.

An Act concerning participation in youth athletics and supplementing chapter 40 of Title 18A of the New Jersey Statutes and Titles 5 and 26 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The board of education of a public school district and the governing board or chief school administrator of a nonpublic school that includes any of the grades kindergarten through 12 shall require that prior to the participation of any student on a school-sponsored  interscholastic or intramural athletic team or squad, the student shall have a physical examination using the Preparticipation Physical Evaluation Form developed jointly by the American Academy of Family Physicians, American Academy of Pediatrics, American College of Sports Medicine, American Medical Society for Sports Medicine, American Orthopaedic Society for Sports Medicine, and the American Osteopathic Academy of Sports Medicine.

     b.    In the event that a student participates in a second interscholastic or intramural team or squad within 365 days of the physical examination conducted pursuant to subsection a. of this section, the board of education of the district or the governing board or chief school administrator of the nonpublic school shall accept Appendix H, Interim Sport Health History Questionnaire, of the Preparticipation Evaluation Form, as authorization for participation in the second team or squad.

     c.     Notwithstanding the provisions of subsections a. and b. of this section to the contrary, a school district or nonpublic school shall not be required to use the Preparticipation Physical Evaluation Form or Appendix H as required pursuant to those subsections until the district or nonpublic school has depleted the supply of physical examination forms it required for sports participation prior to the effective date of this act.

 

     2.    a.   A municipal or county recreation department and a nonprofit youth serving organization as defined in section 1 of P.L.1999, c.432 (C.15A:3A-1) including, but not limited to, Little Leagues, Babe Ruth Leagues, Pop Warner Leagues, Police Athletic Leagues, and youth soccer leagues, which organizes, sponsors, or is otherwise affiliated with youth athletic events that are played on municipal, county, school, or other publicly-owned fields, shall require that prior to the participation of any child in a youth athletic event, the child shall have a physical examination using the Preparticipation Physical Evaluation Form developed jointly by the American Academy of Family Physicians, American Academy of Pediatrics, American College of Sports Medicine, American Medical Society for Sports Medicine, American Orthopaedic Society for Sports Medicine, and the American Osteopathic Academy of Sports Medicine.

     b.    In the event that a child participates in a second athletic league within 365 days of the physical examination conducted pursuant to subsection a. of this section, the municipal or county recreation department or nonprofit youth serving organization shall accept Appendix H, Interim Sport Health History Questionnaire, of the Preparticipation Evaluation Form, as authorization for participation in the second athletic league.

     c.     Notwithstanding the provisions of subsections a. and b. of this section to the contrary, a municipal or county recreation department or nonprofit youth serving organization shall not be required to use the Preparticipation Physical Evaluation Form or Appendix H as required pursuant to those subsections until the municipal or county recreation department or nonprofit youth serving organization has depleted the supply of physical examination forms it required for sports participation prior to the effective date of this act.

 

     3.    a.  A youth camp operating pursuant to P.L.1973, c.375 (C.26:12-1 et seq.) shall require that prior to participation in any camp athletic activity, a child shall have a physical examination using the Preparticipation Physical Evaluation Form developed jointly by the American Academy of Family Physicians, American Academy of Pediatrics, American College of Sports Medicine, American Medical Society for Sports Medicine, American Orthopaedic Society for Sports Medicine, and the American Osteopathic Academy of Sports Medicine.

     b.    Notwithstanding the provisions of subsections a. and b. of this section to the contrary, a youth camp shall not be required to use the Preparticipation Physical Evaluation Form or Appendix H as required pursuant to those subsections until the youth camp has depleted the supply of physical examination forms it required prior to the effective date of this act.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires public and nonpublic schools that include any of the grades kindergarten through 12 to require that prior to the participation of any student on a school-sponsored interscholastic or intramural athletic team or squad, the student has a physical examination using the Preparticipation Physical Evaluation Form developed jointly by the American Academy of Family Physicians, American Academy of Pediatrics, American College of Sports Medicine, American Medical Society for Sports Medicine, American Orthopaedic Society for Sports Medicine, and the American Osteopathic Academy of Sports Medicine.  In the event that a student participates in a second interscholastic or intramural team or squad within 365 days of the physical examination conducted using that form, the public or nonpublic school is to accept Appendix H of that form, which is entitled Interim Sport Health History Questionnaire.  A public or nonpublic school would not be required to use the above forms until the school has depleted the supply of physical examination forms it required prior to the bill's effective date.

     The bill imposes a similar requirement on municipal and county recreation departments, nonprofit youth serving organizations, and youth camps, prior to the participation of any child in athletic activities.
