SYNOPSIS
Memorializes Congress and President to enact legislation to require health care coverage for post-mastectomy inpatient care as in State law.

An Assembly Resolution memorializing Congress and the President of the United States to enact legislation to require health care coverage for inpatient care following a mastectomy identical to that in State law.
Whereas, The Legislature and Governor of New Jersey have acted to protect the health care interests of New Jersey women undergoing a mastectomy by enacting P.L.1997, c.149 (C.17:48-6q et al.); and
Whereas, This law requires that health insurance carriers in this State provide coverage for a minimum of 72 hours of inpatient care following a modified radical mastectomy and a minimum of 48 hours of inpatient care following a simple mastectomy, although the law does not require a patient to receive inpatient care for 72 or 48 hours, as appropriate, if the patient in consultation with the patient's physician determines that a shorter length of stay is medically appropriate; and
Whereas, The provisions of P.L.1997, c.149 (C.17:48-6q et al.) do not apply to self-insured plans, which are exempt from State regulation pursuant to the federal "Employee Retirement Income Security Act of 1974," Pub.L.93-406 (29 U.S.C.s.1001 et seq.); and
Whereas, Because federal law does not require a minimum period of inpatient care following a mastectomy, the mastectomy patients in this State who are covered by self-insured plans do not have the same protection as those covered under health benefits plans that are subject to the provisions of P.L.1997, c.149 (C.17:48-6q et al.); and
Whereas, It is clearly in the best interests of promoting quality health care for all women in New Jersey to have federal law provide the same requirement for inpatient care following a mastectomy as is contained in State law; now, therefore,
Be It Resolved by the General Assembly of the State of New Jersey:
1. This House respectfully memorializes the United States Congress and the President of the United States to enact legislation to require health care coverage for a minimum period of inpatient care following a mastectomy that is identical to that provided under New Jersey law in P.L.1997, c.149 (C.17:48-6q et al.).
2. Duly authenticated copies of this resolution, signed by the Speaker of the General Assembly and attested by the Clerk of the General Assembly, shall be transmitted to the presiding officers of the United States Congress, each of the members of the Congress elected from the State of New Jersey, and the President of the United States.
STATEMENT
This resolution respectfully memorializes the United States Congress and the President of the United States to enact legislation to require health care coverage for a minimum period of inpatient care following a mastectomy that is identical to that provided under New Jersey law in P.L.1997, c.149 (C.17:48-6q et al.).
