SYNOPSIS

     Requires truck and van rental companies to photograph authorized user.

An Act concerning certain rental vehicles and supplementing P.L.1960, c.39 (C.56:8-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

    

     1.    a.   As used in this section:

     "Rental company" means a person engaged in the business of renting trucks or vans.

     "Rental truck or van" means a truck, semitrailer, or van that is rented without a driver and used in the transportation of persons or property other than commercial freight.

     "User" means a person who is authorized to operate a rental truck or van.

     b.    A rental company shall photograph any user prior to delivery of the rental truck or van to the user.  The rental company shall file and retain the user photograph securely for at least 180 days, and make it available to any law enforcement entity upon request.

 

     2.    This act shall take effect on the first day of the third month next following the date of enactment.

 

 

STATEMENT

 

     This bill requires a company that rents trucks or vans to photograph any person authorized to operate a rented truck or van.  The rental company would be required to keep the photograph on file for a minimum of 180 days, and make it available to law enforcement upon request.

     Unfortunately, on occasion, rental trucks and vans have been used maliciously.  Under the bill, law enforcement in these instances could seek, and rental companies could provide, a photograph of the authorized user.
