An Act concerning minority-owned, women-owned businesses, and small businesses and supplementing Title 52 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. The Division of Purchase and Property in the Department of the Treasury shall receive and analyze the information compiled by the division's Chief Diversity Officer and, utilizing these data, submit an annual report to the Governor, and to the Legislature in accordance with section 2 of P.L.1991, c.164 (C.52:14-19.1), on the awarding of contracts to minority-owned and women-owned business enterprises, including but not limited to:
(1) the total number of minority-owned and women-owned business enterprises that applied to request for proposals compared to the total number of all small business enterprises that applied to request for proposals;
(2) the total number of contracts awarded to minority-owned and women-owned business enterprises;
(3) the total value of all contracts awarded and the average value of all contracts awarded to minority-owned and women-owned business enterprises; and
(4) the percentage of the value of those contracts awarded to minority-owned and women-owned business enterprises compared to the value of all contracts awarded to small business enterprises.
2. The Division of Revenue in the Department of Treasury shall be responsible for the administration, operation, and continued development of the central registry, known as the New Jersey Selective Assistance Vendor Information (SAVI) database, which compiles businesses that are registered as a small business enterprise, including businesses certified as a minority-owned or women-owned business enterprise with the State of New Jersey. The purpose of the database shall be to identify businesses eligible for mandated State programs such as the New Jersey Small Business Set Aside program, and to aid in matching buyers and vendors for contracting opportunities.
3. This act shall take effect immediately.
STATEMENT
This bill requires the Division of Purchase and Property in the Department of the Treasury to issue an annual report on public contracts awarded to women-owned and minority-owned businesses. This bill requires the Division of Revenue to administer, operate, and continue to develop the Selective Assistance Vendor Information (SAVI) database in the Division of Revenue.
Currently, the Chief Diversity Officer in the Division of Purchase and Property is required to monitor the State's public contracting process for the purpose of compiling information on the awarding of contracts to minority-owned and women-owned business enterprises, the total value of all contracts and the percentage of the value of those contracts awarded to minority-owned and women-owned business enterprises. This bill would require the division to issue an annual report to the Governor and the Legislature utilizing the information compiled by the Chief Diversity Officer.
The SAVI database currently compiles businesses that are registered as a small business enterprise, including businesses certified as a minority-owned or women-owned business enterprise with the State of New Jersey. The purpose of the database is to identify businesses eligible for mandated State programs such as the New Jersey Small Business Set Aside program, and to aid in matching buyers and vendors for contracting opportunities.
