SYNOPSIS

     Provides a voucher to certain TANF recipients to purchase diapers.

An Act providing for a voucher for the purchase of diapers and1[amending and]1 supplementing P.L.1997, 13.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1[1.  Section 4 of P.L.1997, c. 13 (C.44:10-37) shall be amended to read as follows:

     4.    In computing the cash assistance benefit provided to recipients, the following disregards shall be applied to the earned income of each person in the assistance unit:

     a.     In the case of a recipient who is employed an average of 20 hours or more a week:

     (1)   100% of the earned income shall be disregarded for the first full month in which the earned income would be counted;

     (2)   75% of the earned income shall be disregarded for six consecutive months of employment; and

     (3)   50% of the earned income shall be disregarded for each continuous month of employment thereafter.

     b.    In the case of a recipient who is employed for an average of less than 20 hours a week:

     (1)   100% of the earned income shall be disregarded for the first full month in which the earned income would be counted; and

     (2) 50% of the earned income shall be disregarded for each continuous month of employment thereafter.

     c.     If an employable recipient has a documented disability, as defined by the commissioner by regulation, that limits the person from accepting more than 20 hours of employment per week, the commissioner may waive the 20 hours or more requirement in subsection a. of this section and provide that the recipient shall be entitled to the 75% earned income disregard for six consecutive months of employment, and the 50% earned income disregard for each continuous month of employment thereafter.

     d.  The amount of the voucher received by a recipient pursuant to section 2 of P.L.       c.      (C.            ) (pending before the Legislature as this bill).

     1[2.] 1.1  A recipient, who has an eligible dependent child who is 12 months of age or younger, shall receive a voucher once a month to purchase diapers.  The value of the voucher shall equal $50.  The voucher shall only be used to purchase diapers. The voucher may be issued with other types of assistance received by the recipient.  The amount of the voucher shall not be computed as 1[earned] counted1 income pursuant to section 1[4] 11 of P.L.1997, 1[c.13 (C.44:10-37)] c.14 (C.44:10-44)1.

 

     1[3.] 2.1 The Commissioner of Human Services shall, in accordance with the "Administrative Procedure Act," P.L.1968, c410 (C.52:14B-1 et seq.) adopt any rules and regulations as the commissioner deems necessary to carry out the provisions of this act.

 

     1[4.] 3.1 This act shall take effect 90 days after enactment, except the Commissioner of Human Services may take any anticipatory administrative action in advance as shall be necessary for the implementation of this act.
