SYNOPSIS

     Requires dune construction by permittee, or grant of easement for dune construction or beach replenishment project, as condition of CAFRA permit for beachfront property.

An Act concerning beachfront property in the coastal area and supplementing P.L.1973, c.185 (C.13:19-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The commissioner shall require as a condition of a permit issued pursuant to P.L.1973, c.185 (C.13:19-1 et seq.) for a development on beachfront property:

     a.     the construction and maintenance of a dune in accordance with standards developed by the department and the United States Army Corps of Engineers; or

     b.    an easement over a portion of the beachfront property for the purpose of dune construction or beach replenishment.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require, as a condition of a permit issued by the Department of Environmental Protection (DEP) pursuant to the "Coastal Area Facility Review Act" (CAFRA), P.L.1973, c.185 (C.13:19-1 et seq.), to a beachfront property owner, the construction and maintenance of a dune in accordance with standards developed by the DEP and United States Army Corps of Engineers.  In lieu of constructing and maintaining a dune, the property owner would be required to execute an easement over a portion of the property for the purpose of dune construction or beach replenishment.
