     Establishes 14-day grace period for consumer to cancel contract for cellular telephone service.

An Act concerning cellular telephone company contracts and supplementing Title 56 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Every provider of cellular telephone service shall extend to new cellular telephone service customers, an unconditional right of cancellation of not less than 14 days, for customers to  cancel the service agreement and terminate service without cost or penalty, if the customer finds that the cellular service quality is unsatisfactory. Every new cellular telephone service agreement, including agreements to renew cellular telephone services with an existing provider shall provide, at the time of purchase or renewal, a separate written notice of the right of the customer to cancel pursuant to the provisions of this act, which the customer shall be required to sign and return to the provider prior to the service being activated or continued.

 

     2.    This act shall take effect on the first day of the seventh month after enactment.

 

 

STATEMENT

 

     This bill would require every provider of cellular telephone service to extend a minimum 14-day cancellation period to new customers, during which a customer may cancel the agreement if he finds the cellular service quality unsatisfactory.

     The bill requires that a separate written notice of the right to cancel be provided which the customer would be required to sign and return to the provider prior to the service being activated or continued.
