SYNOPSIS

     Increases penalty for parking within safety zone designated for school bus use.

An Act increasing the penalty for parking within a safety zone designated for school bus use and amending R.S.39:4-203.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    R.S.39:4-203 is amended to read as follows:

     39:4-203  a.  For a violation of a provision of this chapter or any supplement thereto for  which no specific penalty is provided, the offender shall be liable to a penalty of not more than [$50.00] $50 or imprisonment for a term not exceeding 15 days, or both;  except that for a violation of a section of article 11, 13, 14 or 17 of this chapter or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not less than [$50.00] $50 or more than [$200.00] $200 or imprisonment for a term not exceeding 15 days, or both.

     b.    Notwithstanding the penalties provided for in subsection a. of this section, a person who stands or parks a vehicle within a safety zone designated for use by a school bus, as defined by R.S.39:1-1, in violation of subsection c. of R.S.39:4-138, shall be subject to a penalty of $100.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill increases penalties for parking within a safety zone, commonly called a no-parking zone, designated for use by a school bus. Currently, the maximum penalty for parking in a safety zone is a fine of $50. This bill increases the penalty imposed for parking in a safety zone designated for school bus use to $100. This bill intends to discourage drivers from parking within safety zones designated for school bus use, in order to protect the safety of children boarding or exiting a school bus.
