     Requires airport operators to provide notice and hold public hearings prior to implementation of changes in flight paths.

An Act concerning certain airport and air terminal flight paths and supplementing Title 6 of the Revised Statutes and Title 32 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Prior to the implementation of any airport-wide alterations to the flight paths of commercial airlines operating at any airport operated in this State, the airport operator shall hold a public hearing in the county affected by the flight path changes. 

     Notice of the hearing shall be given by the airport operator at least 15 days prior to the hearing to the governing body of the county whose residents will be affected and to the clerk of each municipality in the county whose residents will be affected.  The notice shall also be posted at least 15 days prior to the hearing in a prominent place on the website of the airport operator. 

 

     2.    Prior to the implementation of any air terminal-wide alterations to the flight paths of airplanes operating at any air terminal operated by the Port Authority of New York and New Jersey, the port authority shall hold a public hearing in the county affected by the flight path changes. 

     Notice of the hearing shall be given by the port authority at least 15 days prior to the hearing to the governing body of the county whose residents will be affected and to the clerk of each municipality in the county whose residents will be affected.  The notice shall also be posted at least 15 days prior to the hearing in a prominent place on the website of the port authority.  

 

     3.    a.  Section 1 of this act shall take effect immediately.

     b.    Section 2 of this act shall take effect immediately, but shall remain inoperative until the enactment into law of legislation substantially similar to P.L.     , c.    (C.     ) (pending before the Legislature as this bill) by the State of New York, but if such legislation shall have been enacted prior to the enactment of this act, this act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires airport operators to hold a public hearing in the county affected by flight path changes, prior to the implementation of any airport-wide alterations to the flight paths of commercial airlines operating at any airport operated in this State.  The bill also requires the Port Authority of New York and New Jersey (port authority) to hold a public hearing in the county affected by the flight path changes, prior to the implementation of any air terminal-wide alterations to the flight paths of airplanes operating at any air terminal operated by the port authority.

     Under the bill, airport operators, including the port authority, are required to give notice of the hearing at least 15 days prior to the hearing to the governing body of the county whose residents will be affected and to the clerk of each municipality in the county whose residents will be affected.  The notice is to also be posted at least 15 days prior to the hearing in a prominent place on the airport operator's website.
