An Act concerning dissemination of wage and hour information for tipped workers and supplementing P.L.1966, c.113 (C.34:11-56a et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Every employer subject to any provision of the "New Jersey State Wage and Hour Law," P.L.1966, c.113 (C.34:11-56a et seq.), or to any regulations or orders issued under that act, shall post and keep conspicuously posted in any establishment wherein any employee who customarily and regularly receive tips or gratuities is employed a printed summary of employee rights under the "New Jersey State Wage and Hour Law," or any regulations or orders issued under that act, including, but not limited to: the applicable minimum wage for any employee who customarily and regularly receives tips or gratuities; the applicable overtime minimum wage for any hour worked in excess of 40 hours in any week by an employee who customarily and regularly receives tips or gratuities; and the means by which an employee may report a wage violation against an employer and all other remedies available to an employee whose employer has violated wage and hour requirements as provided under the "New Jersey State Wage and Hour Law," or any other applicable law. The printed summary, approved by the Commissioner of Labor and Workforce Development, shall be furnished to every employer without charge and suitable for reproduction by the employer.

 

     2.    This act shall take effect on the first day of the fourth month next following the date of enactment.

 

 

STATEMENT

 

     This bill requires every employer to post and keep conspicuously posted, in any establishment wherein any employee who customarily and regularly receive tips or gratuities is employed, a printed summary of employee rights under the "New Jersey State Wage and Hour Law," P.L.1966, c.113 (C.34:11-56a et seq.).

     The printed summary must include information concerning the applicable minimum wage for any employee who customarily and regularly receives tips or gratuities, the applicable overtime minimum wage for any hour worked in excess of 40 hours in any week by an employee who customarily and regularly receives tips or gratuities, and the means by which an employee may report a wage violation against an employer and all other remedies available to an employee whose employer has violated wage and hour requirements under the "New Jersey State Wage and Hour Law," or any other applicable law.

     The bill provides that the printed summary must be approved by the Commissioner of Labor and Workforce Development, and must be furnished to every employer without charge and suitable for reproduction by the employer.
