SYNOPSIS
Prohibits cause of action against public entity for weather related accident occurring on public property.

An Act granting public entities immunity from liability in certain weather related accidents and amending N.J.S.59:4-7.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. N.J.S.59:4-7 is amended to read as follows:
59:4-7. Neither a public entity nor a public employee is liable for an injury caused [solely] in any part by the effect of adverse weather conditions on [the use of] streets [and] , highways [of weather conditions] , or any other public property.

2. This act shall take effect immediately.
STATEMENT
This bill would prohibit lawsuits against public entities in situations where weather conditions contributed to an injury which occurred on public property. It is unarguable that a public entity cannot control the weather, and it is the sponsor's hope that this bill will assist public entities at all levels of government by reducing the burdensome insurance and litigation expenses they are forced to incur. This would have a positive impact on the residents of the State, especially the overly burdened property taxpayer, by reducing the cost of government, particularly at the local level.
