SYNOPSIS

     Requires State, local, and school appointed and certain elected officials to report behavior that may violate criminal laws or ethics statutes.

An Act requiring the reporting of certain unlawful or unethical behavior, and supplementing various parts of the statutory law.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    All State elected government officials and heads of State departments, agencies, authorities, and independent commissions shall promptly report to the Attorney General or the proper investigatory agency, as may be appropriate, any conduct by a government officer or employee known to that official that may be considered a violation of the criminal laws of this State, or any statute, rule, regulation or code concerning ethical behavior.

 

     2.    All local government officers and heads of local government agencies, authorities, and independent commissions shall promptly report to the Local Finance Board in the Department of Community Affairs or the proper investigatory agency, as may be appropriate, any conduct by a local government officer or employee known to that official that may be considered a violation of the criminal laws of this State, or any statute, rule, regulation or code concerning ethical behavior.

 

     3.    All administrators, board members and school officials in a local school district and the heads of school district agencies, authorities and independent commissions shall promptly report to the School Ethics Commission in the Department of Education or the proper investigatory agency, as may be appropriate, any conduct by a school district officer or employee known to that official that may be considered a violation of the criminal laws of this State, or any statute, rule, regulation or code concerning ethical behavior.

 

     4.    This act shall take effect immediately

 

 

STATEMENT

 

     This bill provides that all State, local and school board officials, including elected officials at each such level, and heads of departments, agencies, authorities, and independent commissions, must promptly report to the Attorney General, the Local Finance Board in the Department of Community Affairs, the School Ethics Commission in the Department of Education or the proper investigatory agency, as may be appropriate, any conduct by a officer or employee known to that official that may be considered a violation of the criminal laws of this State, or any statute, rule, regulation or code concerning ethical behavior.
