SYNOPSIS
Exempts certain maintenance engineers from heating, ventilating, air conditioning, and refrigeration license requirement.

An Act concerning heating, ventilating, air conditioning, and refrigeration contractors and supplementing P.L.2007, c.211 (C.45:16A-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. The provisions of P.L.2007, c.211 (C.45:16A-1 et seq.) shall not apply to a person who performs HVACR work if:
a. the person is an HVACR maintenance engineer and a regular employee of the owner, lessee, or management company of the property where the work is being performed;
b. the person performs the HVACR work in connection with the business in which the person is employed; and
c. the person and the person's employer do not engage in HVACR contracting for the public.
For purposes of this section, "HVACR maintenance engineer" means a person who performs the repair or maintenance work necessary for the continued normal performance of heating, ventilating, air conditioning, and refrigeration systems.
2. This act shall take effect immediately.
STATEMENT
Under this bill, a person who performs heating, ventilating, air conditioning, and refrigeration (HVACR) work is exempt from the requirement of professional licensure if: (1) the person is an HVACR maintenance engineer and a regular employee of the owner, lessee, or management company of the property where the work is being performed; (2) the person performs the HVACR work in connection with the business in which the person is employed; and (3) the person and the person's employer do not engage in HVACR contracting for the public.
As used in this bill, "HVACR maintenance engineer" means a person who performs the repair or maintenance work necessary for the continued normal performance of heating, ventilating, air conditioning, and refrigeration systems.
