SYNOPSIS
Requires MVC to provide Gold Star Family decals to certain family members of armed services members who died while on active duty.

An Act concerning Gold Star Family decals and supplementing P.L.2011, c.17 (C.39:3-27.141 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The chief administrator, upon receipt of proof satisfactory, shall provide a family member of a member of the armed services who died while on active duty for the United States with two Gold Star Family decals to be affixed to the license plates of a motor vehicle registered in this State.
b. The Gold Star Family decals shall be in the shape of a gold star with the words "Gold Star Family" and designed by the chief administrator.
c. The chief administrator shall provide the Gold Star Family decals to an applicant within seven days of the receipt of proof satisfactory.
d. The Gold Star Family decals shall be displayed on the license plates in a manner prescribed by the chief administrator.
e. The chief administrator may charge a fee for the Gold Star Family decals not to exceed the actual cost of their production and distribution.
f. For the purposes of this section:
"Chief Administrator" means the Chief Administrator of the New Jersey Motor Vehicle Commission.
"Commission" means the New Jersey Motor Vehicle Commission.
"Family member" means the spouse, parent, brother, sister, child, legal guardian, or other legal custodian, whether of the whole or half blood or by adoption, of a member of the armed services who died while on active duty for the United States.
"Proof satisfactory" shall have the same meaning as in subsection a. of section 2 of P.L.2011, c.17 (C.39:3-27.142).
2. This act shall take effect on the first day of the fourth month next following enactment except the chief administrator may take any anticipatory administrative action in advance thereof as shall be necessary for the implementation of this act.
STATEMENT
This bill requires the Chief Administrator of the New Jersey Motor Vehicle Commission (commission) to provide Gold Star Family decals to a family member of a member of the armed services who died while on active duty for the United States. The decals, which are to be in the shape of a gold star with the words "Gold Star Family," are to be affixed to the existing license plates of a motor vehicle registered in the State in a manner approved by the chief administrator.
The bill requires the chief administrator to issue the decals within seven days of receipt of satisfactory proof that the person is the family member of a member of the armed services who died while on active duty for the United States. The bill requires the same documentation as is required for Gold Star Family license plates under current law. A family member is defined in the bill to mean, the spouse, parent, brother, sister, child, legal guardian or other legal custodian, whether of the whole or half blood, or by adoption, of a member of the armed services who died while on active duty for the United States.
Finally, the bill allows the chief administrator to charge a fee for the Gold Star Family decals not to exceed the actual cost of their production and distribution.
