An Act concerning the purchase of lottery tickets, amending P.L.1983, c.80, and supplementing P.L.1970, c.13 (C.5:9-1 et seq.).
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. Section 1 of P.L.1983, c.80 (C.5:9-7.1) is amended to read as follows:
1. Notwithstanding any other provision of law to the contrary, and except as permitted by section 2 of P.L. , c. (C. ) (pending before the Legislature as this bill), no lottery or type of lottery or lottery game shall be authorized or conducted which uses any video mechanical, electrical or other video device, contrivance or machine which, upon the insertion by the participant of a coin, token or similar object therein, or upon payment of any consideration whatsoever, is available to play or operate, the play or operation of which, whether by reason of the skill of the operator or application of the element of chance, or both, may deliver or entitle the person playing or operating the machine to receive cash, tokens to be exchanged for cash, or any other prize, whether the payoff is made automatically from the machine or in any other manner whatsoever.

2. (New section) 1a.1 The State Lottery Commission shall implement a program that allows residents of this State to purchase lottery tickets directly from the Division of the State Lottery using the Internet, electronic mail, text messaging, or any other electronic means deemed appropriate by the commission. The program shall enable players to purchase tickets only for lottery games for which there are drawings and for which tickets are also sold through lottery sales agents. A player shall be permitted to pay for a ticket using a 1[credit or]1 debit card, or a check or cash deposited with the division 1, but not a credit card1. Players also shall be permitted to buy tickets through a subscription that allows players to purchase tickets over an extended period of time. Winning ticket holders who have purchased tickets pursuant to this section shall be notified by electronic mail, text message, or other electronic means immediately following a drawing. The commission shall establish procedures for the payment of winning tickets holders which may include, but shall not be limited to, crediting amounts won to a player's account or direct deposit into a player's account at a financial institution.
The commission may establish and operate the program using employees of the division or it may contract with one or more qualified vendors to operate the program. A contract entered into with a qualified vendor pursuant to this section may provide that the vendor shall be compensated through a percentage of the purchase price of each ticket sold through the program. Any payments to a vendor shall be deemed to be an expense of the division in its operation of the lottery. The commission shall ensure that the program includes security measures that are sufficient to protect against fraud, prevent wagering by underage persons, and protect the personal and financial information of players. The program shall be implemented in a way that is consistent with any applicable federal laws and any agreements addressing this State's participation in multi-state lotteries.
1b. Notwithstanding the provisions of any other law, rule, or regulation to the contrary, the State Lottery Commission shall annually distribute equally among all licensed lottery sales agents operating in New Jersey, a sum equal to 5% of the amounts generated from the sale of lottery tickets through the program authorized under subsection a. of this section.1
13. (New section) Notwithstanding the provisions of any other law, rule, or regulation to the contrary, a licensed lottery sales agent operating in New Jersey may accept debit cards, but not credit cards, from patrons for the purchase of lottery tickets at the sales location.1
