SYNOPSIS
Establishes amber light duration at traffic control signals.

An Act concerning traffic control signals and amending R.S.39:4-106 and R.S.39:4-107.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. R.S.39:4-106 is amended to read as follows:
39:4-106. The colors shall be shown in the following sequence: A green light displayed for a predetermined number of seconds followed by an amber light for [a reasonable] the time [necessary for the clearance of traffic] period established in R.S.39:4-107, followed by a red light, followed by a green light. [The] Except as provided in R.S.39:4-107, the timing of all lights shall be determined by the volume of traffic.

2. R.S.39:4-107 is amended to read as follows:
39:4-107. a. The period or cycle of traffic control signals shall be based on counts of turning and through traffic and study of turns, special intersections, distance between intersections, and speeds permitted.
b. Notwithstanding the provisions of subsection a. of this section, the minimum duration of an amber light at a traffic control signal shall be:
(1) four seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of 30 miles per hour or less;
(2) four and one half seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 30 miles per hour but less than or equal to 35 miles per hour;
(3) five seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 35 miles per hour but less than or equal to 40 miles per hour;
(4) five and one half seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 40 miles per hour but less than or equal to 45 miles per hour;
(5) six seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 45 miles per hour but less than or equal to 50 miles per hour;
(6) six and one half seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 50 miles per hour but less than or equal to 55 miles per hour; and
(7) seven seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 55 miles per hour.

3. This act shall take effect on the first day of the twelfth month next following enactment.
STATEMENT
This bill establishes a statutory standard duration of the amber light at intersections with a traffic control signal. Under the bill's provisions, an amber light is required to have a minimum duration of:
(a) four seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of 30 miles per hour or less;
(b) four and one half seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 30 miles per hour but less than or equal to 35 miles per hour;
(c) five seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 35 miles per hour but less than or equal to 40 miles per hour;
(d) five and one half seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 40 miles per hour but less than or equal to 45 miles per hour;
(e) six seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 45 miles per hour but less than or equal to 50 miles per hour;
(f) six and one half seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 50 miles per hour but less than or equal to 55 miles per hour; and
(g) seven seconds if at least 85 percent of the vehicular traffic approaching the signal is traveling at a speed of more than 55 miles per hour.
