     Establishes Trenton Capital City Aid program.

An Act establishing the Trenton Capital City Aid program and supplementing chapter 27D of Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.  a.  There shall be appropriated annually by the Legislature for each State fiscal year an amount not less than $16,500,000 for the Trenton Capital City Aid Program, or an amount not less than the amount determined pursuant to subsection b. of this section.  The payment of Trenton Capital City Aid Program aid shall be used solely and exclusively by the City of Trenton for the purpose of reducing the amount the City of Trenton is required to raise by the local property tax levy for municipal purposes.  If the amount of the payment exceeds the amount required to be raised by local property tax levy for municipal purposes, the balance of the payment shall be used to reduce the amount the City of Trenton is required to collect for county or school purposes, notwithstanding the provisions of this or any other law to the contrary.  The Director of the Division of Local Government Services in the Department of Community Affairs shall certify annually that the City of Trenton has complied with the requirements set forth herein.

     b.  Notwithstanding any law to the contrary, the amount appropriated for Trenton Capital City Aid Program in a State fiscal year shall be equal to the amount appropriated for Trenton Capital City Aid Program in the prior State fiscal year multiplied by the sum of 1.0 and the CPI or zero, whichever is greater.  As used in this section, "CPI" means the average annual change, expressed as a decimal, in the consumer price index for the New York City and Philadelphia areas during the State fiscal year prior to the presentation of the Governor's budget message as reported by the United States Department of Labor.

 

     2.  This act shall take effect immediately.

 

 

STATEMENT

 

     This bill codifies the Trenton Capital City Aid Program currently in the Department of Community Affairs which has been funded by the Legislature in fiscal years 2004 and 2005 in the amount of $16.5 million.  Under this bill the Trenton Capital City Aid program would be funded annually by increasing the prior year's appropriation by the sum of 1.0 and the CPI or zero, whichever is greater.  As defined in this bill, "CPI" means the average annual change, expressed as a decimal, in the consumer price index for the New York City and Philadelphia areas during the State fiscal year prior to the presentation of the Governor's budget message as reported by the United States Department of Labor.  The city as a government center, with its significant presence of federal, State, county and city offices and facilities that are off the property tax rolls, severely impacts the city's ability to fund its locally budgeted services.  This bill would provide a stable source of funding to aid the city in providing its local municipal services.
