An Act concerning Class Two special law enforcement officers and supplementing chapter 14 of Title 40A of the New Jersey Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. Whenever a Class Two special law enforcement officer is hired by a municipality other than the municipality which initially appointed the officer and paid that officer's examination and training costs, the hiring municipality shall be liable to the former municipality for the total certified costs incurred by the former municipality in the examination, hiring, and training of the officer.
b. For the purposes of this act:
"Examination costs" means and includes, but is not limited to, the costs of all qualifying examinations and the public advertisements for these examinations; and
"Class Two special law enforcement officer" means a law enforcement officer appointed pursuant to the provisions of the "Special Law Enforcement Officers' Act," P.L.1985, c.439 (C.40A:14-146.8 et seq.).
"Training costs" means the police training course fees and the base salary received while attending the police training course.
c. The Attorney General shall promulgate guidelines necessary to effectuate the purposes of this act.
2. This act shall take effect immediately.
STATEMENT
This bill would require a municipality which hires a Class Two special law enforcement officer whose examination and training costs were paid by another municipality to reimburse that other municipality for the total certified costs incurred by that municipality in the initial examination, hiring, and training of the officer.
Class Two special law enforcement officers are employed by municipalities for periods of one year or less. For example, these officers may be hired by resort municipalities during their seasonal periods. When a municipality examines, trains and hires a Class Two special law enforcement officer for one year, that municipality suffers a substantial monetary loss if the officer accepts employment in another municipality in a subsequent year. This bill would address this problem by requiring a municipality that did not train the officer to reimburse the municipality that provided the training.
