     Requires Department of Labor and Workforce Development to establish certification program for green jobs and provides tax credits.

An Act establishing a certification program for green jobs through the New Jersey Department of Labor and Workforce Development, providing tax credits, and supplementing various parts of the statutory law.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a. As used in this section, "green job" means an occupation, or aspect of employment, that deals with renewable energy, energy conservation, energy efficiency, energy sustainability, or reducing environmental impact.

     b.    The Department of Labor and Workforce Development shall within 180 days of the enactment of this act, establish a program within the Center for Occupational Employment Information, established pursuant to section 27 of P.L.2005, c.354 (C.34:1A-86), for the certification of persons employed in green jobs. Participation in this program shall be voluntary. The department shall require applicants for certification pursuant to this section to comply with all applicable licensing and business permit requirements in the State of New Jersey.

     c.     The commissioner shall, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), adopt rules and regulations necessary to implement the provisions of this act.

 

     2.    a. A taxpayer shall be allowed a credit against the tax imposed pursuant to section 5 of P.L.1945, c.162 (C.54:10A-5), in an amount equal to 100% of the taxpayer's expense during the privilege period to pay for green job certification and any training or education programs required for certification, pursuant to section 1 of P.L.    , c   (C.       ) (pending before the Legislature as this bill).

     b.    he priority in which credits allowed pursuant to this section and any other credits shall be taken against the tax imposed pursuant to section 5 of P.L.1945, c.162 (C.54:10A-5) shall be determined by the director of Taxation. Credits allowable pursuant to this section shall be applied in the order of the credits' privilege periods. The amount of the credits applied under this section against the tax imposed pursuant to section 5 of P.L.1945, c.162, for a privilege period shall not, in combination with any other credits applied, exceed 50% of the tax liability otherwise due and shall not reduce the tax liability to an amount less than the statutory minimum provided in subsection (e) of section 5 of P.L.1945, c.162.

     c.     he amount of any credit otherwise allowable under this section that cannot be applied for the privilege period due to the limitations of subsection b. of this section may be carried over, if necessary, to the five privilege periods following the period for which the amount was allowed.

 

     3.    a. A taxpayer shall be allowed a credit against the tax otherwise due for the taxable year under the "New Jersey Gross Income Tax Act," N.J.S.A.54A:1-1 et seq., in an amount equal to 100% of the taxpayer's expense during the taxable year to pay for green job certification and any training or education programs required for certification, pursuant to section 1 of P.L.   , c   (C.   ) (pending before the Legislature as this bill).

     b.    The priority in which any other credits allowed pursuant to this section and any other credits shall be taken against the tax imposed pursuant to N.J.S.A.54A:1-1 et seq. shall be determined by the director. Credits allowable pursuant to this section shall be applied in the order of the credits' privilege periods. The amount of the credits applied under this section against the tax imposed pursuant to N.J.S.A.54A:1-1 et seq., for a privilege period shall not, in combination with any other credits applied, exceed 50% of the tax liability otherwise due and shall not reduce the tax liability to an amount less than the statutory minimum provided under N.J.S.A.54A:1-1 et seq.

     c.     The amount of the credit otherwise allowable under this section which cannot be applied for the privilege period due to the limitations of subsection b. of this section may be carried over, if necessary to the five privilege periods following the privilege period for which the credit was allowed.

     d.    A partnership shall not be allowed a credit under this section directly, but the amount of credit of a taxpayer in respect of a distributive share of partnership income under the "New Jersey Gross Income Tax Act," N.J.S.A.54A:1-1 et seq., shall be determined by allocating to the taxpayer that proportion of the credit acquired by the partnership that is equal to the taxpayer's share, whether or not distributed, of the total distributive income or gain of the partnership for its taxable year ending within or with the taxpayer's taxable year.

 

     4.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill establishes a green job certification program through the Department of Labor and Workforce Development. The program would be established within the Center for Occupational Employment Information for the certification of persons employed in green jobs. The bill also allows a credit against the corporation business tax and the New Jersey gross income tax to defray the costs associated with green job certification.
