STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Thirteen

AN ACT relative to the treatment of medical support in child support cases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

81:1 New Paragraph; Definition of Parental Support Obligation. Amend RSA 458-C:2 by inserting after paragraph VIII the following new paragraph:

VIII-a. “Parental support obligation” means the proportional amount of the total support obligation allocated to each parent under RSA 458-C:3, II(b) and (c).

81:2 Definition of Medical Support Obligation. Amend RSA 458-C:2, IV-a to read as follows:

IV-a. “Medical support obligation” means the obligation of either or both parents to provide health insurance coverage for a dependent child and/or to pay a monetary sum toward the cost of health insurance provided by a public entity, parent, or other person[, or for medical costs not covered by insurance, including payment for the cost of premiums, co-payments, and deductibles].

81:3 Child Support Formula; Calculation of Self-Support Reserve. Amend RSA 458-C:3, IV(b) to read as follows:

(b) If the obligor parent’s gross income is greater than the self-support reserve but payment of the [order] parental support obligation as calculated under this chapter would reduce the obligor parent’s adjusted gross income below the self-support reserve, the [obligor parent’s share of the total support obligation] presumptive child support obligation shall be [presumed to be] the difference between the self-support reserve and [that] the obligor parent’s adjusted gross income, but in any event shall be no less than the amount of a minimum support order.

81:4 Effective Date. This act shall take effect upon its passage.
