This bill increases the permitted number of game dates of bingo and lucky 7 ticket sales allowed for licensees each month and within each calendar year, changes the reimbursement amounts that may be paid to bona fide members of charitable organizations, and allows Lucky 7 tickets to be sold in conjuction with bingo games.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to the operation of bingo games and the sale of lucky 7 tickets.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Bingo Licenses; Game Dates.  Amend RSA 287-E:6, II(a)-(b) to read as follows:

(a) No more than one license shall be issued to a charitable organization per calendar month, and the license shall permit no more than [10] 16 game dates of bingo in one calendar month, and in no more than one town or city which has authorized bingo games under RSA 287-E:27. The license shall expire on the last game date authorized under said license.

(b) The provisions of subparagraph II(a) notwithstanding, a license may be issued to a charitable organization per fiscal year, and the license shall permit no more than [10] 16 game dates of bingo in one calendar month and no more than [120] 192 game dates of bingo in one calendar year. The license shall expire on the last game date authorized under the license. Charitable organizations electing to receive an annual license under this paragraph shall be ineligible to receive concurrently a monthly license under subparagraph II(a), and charitable organizations licensed under subparagraph II(a) shall be ineligible to receive concurrently an annual license under this subparagraph.

2  Operation of Bingo Games.  Amend RSA 287-E:7, II(a) to read as follows:

II.(a) No compensation shall be paid to bona fide members of a charitable organization or others, except as provided in subparagraph (b), who operate or assist in the operation of a bingo game. Compensation shall include, but is not necessarily limited to, money or any other thing of value. Bona fide members of a charitable organization who operate or assist in the operation of bingo games may be reimbursed for their [out-of-pocket] expenses in an amount not to exceed [$25] $50 per game date, provided that such expenses are [itemized and] submitted in writing to the charitable organization.

3  New Subparagraph; Sale of Lucky 7 Tickets.  Amend RSA 287-E:21, II by inserting after subparagraph (c) the following new subparagraph:

(d)  Lucky 7 tickets may be sold in conjunction with bingo games for no more than 16 game dates in one calendar month, and no more than 192 game dates in one calendar year.

4  Sale of Lucky 7 Tickets.  Amend RSA 287-E:21, III-a to read as follows:

III-a.  Lucky 7 tickets may be sold by dispenser devices approved by the commission and located at the regular meeting place of, or at a facility owned, leased, or utilized by, the licensee for its activities, including facilities licensed under RSA 287-D, provided that such device dispenses a paper or cardboard ticket and specifications for such dispenser device are contained in the rules of the commission.  Any permitted lucky 7 device shall not be in the nature of a slot machine and the outcome of any wager involving a permitted lucky 7 device shall be determined by the cardboard or paper ticket, or the video monitor when so equipped.  Devices capable of displaying the outcome on a video monitor shall provide the player with the option of printing a paper ticket.  No charitable organization shall be licensed to sell lucky 7 tickets for more than [10] 16 days per month when selling tickets at a facility licensed under RSA 287-D.  Lucky 7 tickets sold at said facilities may be sold during all hours for which the facility is licensed to operate.

5  Effective Date.  This act shall take effect upon its passage.

METHODOLOGY:

This bill will increase the number of bingo events a licensed charitable organization can offer from 10 in one calendar month and 120 in one calendar year, to 16 and 192, respectively, therefore allowing each to offer up to 72 more events per year. The Lottery Commission states there are currently approximately 52 charitable organizations licensed to offer bingo (to which this bill is not expected to change) and the license event fee is $25. To this extent, the maximum annual revenue created by this bill could be $93,600 (72 events X 52 charitable organizations X $25 fee). Based on staffing (and other) limitations, the Lottery Commission does not expect each organization to max out on possible bingo events, and anticipates the increase to be no more than 25%, or $23,400 per year in additional revenue. Lottery revenue is credited to the lottery fund, with net revenues after expenditures being credited to the state education trust fund. It is assumed this bill will not impact bingo games until July 2023 at the earliest.
