STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

A RESOLUTION a resolution to urge the investigation of due process in family court cases.

 

Whereas, the due process protections of litigants in family court are likely inadequate; now, therefore, be it

Resolved by the House of Representatives:

That the committee on children and family law or a select committee appointed by the speaker of the house of representatives shall investigate the allegations concerning the circuit court, family division, of denial of due process for litigants, including, but not limited to suspension of court rules in a partial or arbitrary manner, and failure adhere to statutory deadlines and requirements; and

That the committee shall hold not less than 3 public hearings to hear testimony from current and former litigants or persons directly knowledgeable regarding these issues.  The hearings shall be noticed in at least one state-wide newspaper one week in advance of the hearing.  Hearings may be held in public venues other than the Legislative Office Building around the state to facilitate public participation; and

That pursuant to the public hearings of litigants, the committee may hold additional public hearings to inquire of jurists or division of children, youth, and families employees regarding the veracity of the facts, or the justification for actions taken.  If necessary, the committee shall have the power to subpoena and compel attendance of state officers; and

That the house clerk shall forward copies of this resolution to the speaker of the house of representatives, the senate president, the governor, the chairperson of the house children and family law committee, and the chairperson of the senate health and human services committee and to the administrative judge of the circuit court.
