HOUSE BILL 627-FN
AN ACT relative to “essential benefits” under federal health care reform.
COMMITTEE: Commerce and Consumer Affairs
This bill provides that any state insurance mandate that exceeds or which offers better benefits than the “essential benefits” section of the Patient Protection and Affordable Care Act of 2009 as amended and which mandate is required to be paid for by the state, shall not be available to the insured.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT relative to “essential benefits” under federal health care reform.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Mandates Exceeding “Essential Benefits” Under the Act Unavailable. Amend RSA 415 by inserting after section 24 the following new section:
415:25 Mandates Exceeding “Essential Benefits” Unavailable. Notwithstanding any provision of law to the contrary, any insurance mandate or portion of such mandate established under this Title that the state is required to pay for and which exceeds or offers better benefits to an insured than the “essential benefits” provided under the Patient Protection and Affordable Care Act of 2009 (Public Law 111-148) as amended by the Health Care and Education Reconciliation Act of 2010 (Public Law 111-152) shall be unavailable to the insured. The insured shall only be entitled to the same “essential benefits” that are provided under the federal act.
2 Effective Date. This act shall take effect 60 days after its passage.

HB 627 FISCAL NOTE
AN ACT relative to “essential benefits” under federal health care reform.
FISCAL IMPACT:
The Department of Insurance states this bill will have an indeterminable fiscal impact on state revenue and expenditures in FY 2011 and in each year thereafter. There will be no fiscal impact on county or local revenue and expenditures.
METHODOLOGY:
The Department of Insurance indicated the Patient Protection and Affordable Care Act requires states to pay the cost of state mandated insurance benefits, that are not included in the federal essential benefits to subsidy-eligible individuals obtaining coverage through the federally required health benefit exchange. This bill would prevent the state mandates not included in the federal essential benefits from being available through the health benefit exchange to subsidy eligible individuals. The Department is unable to determine the fiscal impact because it is not known which benefits the federal government will include in the federal essential benefits or how many people will be entitled to a subsidy through the health benefit exchange.
