AN ACT relative to public health, safety, and state sovereignty.

ANALYSIS

 

This bill:

 

I.  Provides that the World Health Organization, the United Nations, and the World Economic Forum shall have no jurisdiction in New Hampshire.

 

II.  Removes a reference to medical schools recognized by the World Health Organization and replaces it with a reference to the World Directory of Medical Schools.

 

III.  Creates a cause of action against counties, cities, towns, precincts, water districts, school districts, school administrative units, or quasi-public entities who create and enforce policies based on the claims of the World Health Organization, the United Nations, and the World Economic Forum.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Five

 

AN ACT relative to public health, safety, and state sovereignty.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1 World Health Organization, United Nations, and World Economic Forum; Jurisdiction.  The World Health Organization, the United Nations, and the World Economic Forum shall have no jurisdiction or power within the state of New Hampshire. No rule, regulation, fee, tax, policy, or mandate of any kind of the World Health Organization, United Nations, and the World Economic Forum shall be enforced or implemented by the state of New Hampshire and it's political subdivisions, including, but not limited to, counties, cities, towns, precincts, water districts, school districts, school administrative units, or quasi-public entities.

2  Qualifications for Licenses; UNWHO Removed.  Amend RSA 329:12, I(d)(4) to read as follows:

(4) Has studied the treatment of human ailments in a medical school maintaining at the time of such studies a standard satisfactory to the Accreditation Council for Medical Education and has graduated from such school or has studied medicine in a medical school located outside the United States which is recognized by the [United Nations World Health Organization (UNWHO)] World Directory of Medical Schools and had such studies confirmed by Educational Commission for Foreign Medical Graduates (ECFMG) Certification;

3  New Section; Claims Arising from Government Entities Relying on Claims of the World Health Organization, The United Nations, and The World Economic Forum.  Amend RSA 541-B by inserting after section 21-a the following new section:

541-B:21-b Claims Arising From the Government Entities Relying on Claims of the World Health Organization, The United Nations, and The World Economic Forum.

I. Without otherwise limiting or defining the sovereign immunity of the state and its agencies, this chapter shall apply to all claims against any counties, cities, towns, precincts, water districts, school districts, school administrative units, or quasi-public entities or any employee, trustee, or director of such when acting in the scope of such person's elected or appointed capacity, who create and enforce policies which rely on the claims of The World Health Organization, The United Nations, and The World Economic Forum.

II. The limitations on awards provided in RSA 541-B:14 shall not be increased by the proceeds from any insurance policy procured by a nonprofit entity, or any employee of such entity, included under RSA 541-B:21-b, I.

4  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill establishes that certain world organizations shall have no jurisdiction in New Hampshire.  In addition, the bill creates a private cause of action against municipalities and other public or quasi-public entities who violate the bill's provisions.  While it is unclear how many cases may be brought as a result of the bill, the Judicial Branch has provided the following cost information with respect to civil cases and related fees:
