STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Three
AN ACT relative to public school human rights complaints.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Public School Human Rights Complaints. Amend RSA 354-A:28 by inserting after paragraph I the following new paragraph:
I-a. The department of education may file a complaint on the behalf of person aggrieved by a discriminatory practice by a school or school district. RSA 354-A:19 shall apply to any retaliation or discrimination against any person on whose behalf a complaint has been filed by the department.
2 Effective Date. This act shall take effect January 1, 2024.

METHODOLOGY:
This bill allows the Department of Education to file charges of discrimination on behalf of an aggrieved party with the Human Rights Commission. The Commission states the fiscal impact is indeterminable at this time because it is unknown how many cases may result from this bill.
The Department of Education states it does not expect this bill to impact its budget.
