STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT establishing a commission to study revisions to occupational regulation of pharmacists and pharmacies.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Commission to Study Revisions to the Laws Governing Pharmacists and Pharmacies.  Amend RSA 318 by inserting after section 68 the following new subdivision:

Commission to Study Revisions to the Laws Governing Pharmacists and Pharmacies

318:69  Commission to Study Revisions to the Laws Governing Pharmacists and Pharmacies.  

I.  There is established a commission to study revisions to the laws governing pharmacists and pharmacies.  The members of the commission shall be as follows:

(a)  Three members of the house of representatives, one of whom shall be from the executive departments and administration committee, and one of whom shall be from the health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.

(b)  One member of the senate, appointed by the president of the senate.

(c)  Two members of the New Hampshire board of pharmacy, appointed by the board.

(d)  One member of the New Hampshire Pharmacists Association, appointed by the association.

(e) One member of the New Hampshire Health System Pharmacist Society, appointed by the society.

(f)  One member of the New Hampshire Independent Pharmacy association, appointed by the association.

(g)  One member of the New Hampshire chapter of the National Association of Chain Drug Stores, appointed by the association.

(h)  One member of the New Hampshire Hospital Association, appointed by the association.

II.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

III.  The commission shall study revisions to the laws governing pharmacists and pharmacies to update statutes to better reflect current standards for pharmacists and pharmacies, and make recommendations for future legislation.

IV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Six members of the commission shall constitute quorum.

V.  The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, and the governor on or before November 1, 2023.

2  Repeal.  RSA 318:69, relative to the commission to study revisions to the laws governing pharmacists and pharmacies, is repealed.

3  Effective Date.  

I.  Section 2 of this act shall take effect November 1, 2023.

II.  The remainder of this act shall take effect upon its passage.
