STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT establishing a right to submit evidence and testimony in family court proceedings.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Judicial Branch Family Division; Right to Present Evidence and Testimony.  Amend RSA 490-D by inserting after section 3 the following new section:

490-D:3-a  Right to Present Evidence and Testimony.  The parties in any family court proceeding shall have the right to present evidence and testimony.  This right shall not be limited by the presiding judge, magistrate, or marital master, or by the New Hampshire rules of evidence, or the rules of the circuit court family division.  The court shall note in the record of the proceedings any evidence not admitted into the record, including the specific evidence or testimony not admitted, and the reason it was not admitted.

2  Effective Date.  This act shall take effect 60 days after its passage.
