ANALYSIS

 

This bill requires the department of education to hire an attorney for the sole purpose to review the content and structure of the education laws.  The cost shall be paid from the education trust fund.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT making an appropriation to the department of education for an attorney to recodify education laws.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Department of Education; Attorney to Recodify Education Laws.

I.  The department shall seek to hire an attorney for the sole purpose to review the content and structure of the education laws to include, but not limited to, the following:

(a)  Review the content and structure of the education laws contained within Title XV, Chapters RSA 186 through 200-N;

(b)  Identify statutes within Title XV which are duplicative;

(c)  Identify statutes within Title XV which are contrary to other statutes within Title XV; and

(d)  Identify areas within Title XV which can be consolidated.

II.  The attorney shall report the findings and any recommendations for proposed legislation to the commissioner of the department of education.

III.  The commissioner or designee shall have exclusive supervisory authority over the attorney.

IV.  Such work as set forth above, shall be completed by September 30, 2024.

2  Department of Education; Appropriation.  The sum of $100,000 for the biennium ending June 30, 2024, is hereby appropriated to the department of education to review the content and structure of the education laws as set forth in Title XV, RSA 186 through 200-N, for the purpose of identifying laws which are duplicative or contradictory and areas which can be consolidated.  Notwithstanding restrictions on the use of moneys in the education trust fund in RSA 198:39, said appropriation shall be a charge against the education trust fund and shall be nonlapsing.

3  Effective Date.  This act shall take effect July 1, 2023.

METHODOLOGY:

This bill makes an education trust fund appropriation to the Department of Education of $100,000 in the fiscal year ending June 30, 2024, for the purpose of hiring an attorney to perform a review of state education laws. The Department assumes this work would be completed through contracted services and it is assumed all funds would be expended in FY 2024.
