STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to site evaluation committee criteria for energy facility siting.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Energy Facility Siting; Terms and Conditions.  Amend RSA 162-H:16, IV(c) to read as follows:

(c)  The site and facility will not have an unreasonable adverse effect on property within the impact area of the facility, as determined by evidence used to establish diminution of value in other proceedings, including but not limited to eminent domain and municipal appraisals, or on aesthetics, historic sites, air and water quality, the natural environment, and public health and safety.  An unreasonable adverse effect on municipal property shall be determined by whether the site and facility would diminish the value of such municipal property if it were private property.

2  Effective Date.  This act shall take effect 60 days after its passage.
