AN ACT relative to documentation required for registration of certain title exempted vehicles and modifying the requirements for removal and sale of certain vehicles.

ANALYSIS

 

This bill requires the town or city clerk to retain a copy of the bill of sale and certificate of registration or the certificate of title for certain title exempted vehicles.  This bill also modifies the requirements for removal and sale of certain vehicles.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to documentation required for registration of certain title exempted vehicles and modifying the requirements for removal and sale of certain vehicles.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Registration of Certain Title Exempted Vehicles.  Amend RSA 261:2-a to read as follows:

261:2-a  Registration of Certain Title Exempted Vehicles.  Notwithstanding the provisions of RSA 261:2 and RSA 261:148, no person shall register a motor vehicle exempted under RSA 261:3, I(k) in this state without first providing a previously issued, current or expired New Hampshire certificate of registration, a valid New Hampshire or out-of-state certificate of title, an application for a certificate of title, or a current New Hampshire vehicle identification number verification form as prescribed by the director.  For the purposes of this section, a temporary registration issued pursuant to RSA 261:57 does not meet the requirement of a previously issued New Hampshire certificate of registration.  The town or city clerk that issues the permit [may] shall copy the bill of sale and the New Hampshire certificate of registration or the certificate of title for their records, but shall return the original bill of sale and the New Hampshire certificate of registration or the certificate of title to the person registering the vehicle upon issuing the permit.  Any person who violates the provisions of this section shall be guilty of a misdemeanor.

2  Abandoned Vehicles; Notice of Removal.  Amend RSA 262:34 to read as follows:

262:34  Notice of Removal.  Whenever an authorized official or the owner or person in lawful possession of private property directs the removal and storage of a vehicle as permitted in this subdivision, he or she shall, if he or she knows or is able to ascertain from the registration records of the division the name and address of record of the registered owner of the vehicle, attempt to give or have given by the most practicable means, notice of the fact of such removal and the place to which said vehicle has been removed.  If the authorized official does not know and is not able to ascertain the name of the owner, or for any other reason is unable to give notice to the owner as provided in this section, such notice shall be filed with the director within 30 days of the removal, which notice shall be placed on file and results of owner and lienholder information shall be mailed to the custodian of the vehicle, by said director and open to public inspection.

3  Abandoned Vehicles; Notice of Sale.  Amend RSA 262:38 to read as follows:

262:38  Notice of Sale.  Notice of sale shall be given by posting notices thereof in 2 or more public places in the town or city where the property is stored, at least 14 days before the sale and, if the current retail value of the vehicle exceeds $1,000, as determined in good faith and by a credible method, by publishing the notice at least once in a newspaper of general circulation in the area.  If the last place of abode of the owner of such vehicle is known to or may be ascertained by such garage owner or keeper by the exercise of reasonable diligence, a notice of the time and place of the sale shall be given by the garage owner by registered or certified mail, or in person, at least [10] 14 days prior to the sale.

4  Effective Date.  This act shall take effect upon its passage.
