STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT relative to voluntary registration for independent contractors under workers’ compensation law.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Voluntary Registration for Independent Contractors. Amend RSA 281-A by inserting after section 4-b the following new section:

281-A:4-c Voluntary Registration for Independent Contractors.

I. The commissioner shall design and implement a voluntary registration program for independent contractors for the purposes of this chapter.

II. An independent contractor who agrees to voluntarily register for a period of one year shall complete a registration form supplied by the commissioner. The registration shall apply only to the type of business operation described in the form. The registration shall require that the individual or entity choosing to register as an independent contractor address the statutory requirements under RSA 281-A:2, VI(b) and include an explanation relative to the manner in which the individual or entity qualifies under each requirement. The registration form shall also include explanations of the consequences and possible penalties of misrepresenting one’s employment status. The form shall be notarized prior to submission to the commissioner and shall be binding on the independent contractor; provided that the registration shall also include a provision for the independent contractor to opt out of the status prior to the end of the registration year should conditions warrant such action. Under this section, a worker who registered as an independent contractor and who incurs an injury or illness during the registration year in the type of business operation indicated on the form shall not be eligible for benefits under this chapter.

2 Workers’ Compensation; Rulemaking. Amend RSA 281-A:60, I(s) to read as follows:

(s) Procedures for establishing a voluntary registration program for independent contractors under RSA 281-A:4-c.

(t) Any other matter necessary to the enforcement or administration of this chapter.

3 Effective Date. This act shall take effect 60 days after its passage.
