This bill authorizes persons with medical conditions to apply for a special permit to waive the prohibition on automobile after market window tinting on the left and right side of the driver.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to after market window tinting on motor vehicles for drivers with medical conditions.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Obstruction to Driver's View or Riding Mechanism.  Amend RSA 265:95, II(a) to read as follows:

(a) Except as permitted by subparagraph (b), no person shall drive upon any way any vehicle with any sign, poster, sticker, or other nontransparent material upon or adjacent to the front windshield, side wings, or side or rear windows of such vehicle which shall obstruct the driver's clear view of the way or any intersecting way, unless authorized by the director so to do. No person shall drive upon any way any vehicle with after market tinting on the windshield, as prohibited under RSA 266:58-a, unless issued a special permit pursuant to RSA 266:61-a, IX.

2  Tinted Glass.  Amend RSA 266:58-a, III-a to read as follows:

III-a. Persons who require for medical reasons after market tinting on the windshield or on the windows to the left and right of the driver may apply for a special permit pursuant to RSA 266:61-a, IX.

3  Equipment Waiver for Disabled.  RSA 266:61-a, IX is repealed and reenacted to read as follows:

IX. The commissioner shall waive the requirements of RSA 266:58-a and issue a special permit to a person who provides the commissioner with a signed letter from their doctor, primary care provider, optometrist, ophthalmologist, or any other medical practitioner who has a relationship with the person requesting the waiver, saying: "I _____ (practitioner name) swear on penalty of perjury that ________ (patient name) born ______ (patient DOB) has been diagnosed with or takes medications that cause a condition which tinted windows would reduce the severity of or prevent the symptoms of the condition." Diagnoses known to be improved by window tinting include, but are not limited to, photophobia, migraines, lupus, melanoma, porphyria, cockayne syndrome, albinism, and solar urticaria. Such waiver shall be granted in accordance with this section and shall only authorize the use of after market tinted windows with a light transmittance of not less than 35 percent. The commissioner may forward any sworn statements to the licensing agency for the practitioner to review suspicious waiver submissions.

4  Effective Date.  This act shall take effect January 1, 2024.
