AN ACT relative to the patients’ bill of rights.

ANALYSIS

This bill declares that if a patient admitted to a facility is not of sound mind as determined by a physician or a court, the wishes of the patient’s immediate family or guardian shall take precedence over the provisions of the patients’ bill of rights.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to the patients’ bill of rights.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Exception to Patients’ Bill of Rights. Amend RSA 151 by inserting after section 21-a the following new section:

151:21-aa Exception to Patients’ Bill of Rights. If a patient admitted to a facility, except a residential care facility, is not of sound mind as determined by a physician or a court, the wishes of the patient’s immediate family or legal guardian shall take precedence over the provisions of RSA 151:21.

2 Effective Date. This act shall take effect 60 days after its passage.
