AN ACT relative to the law regarding Medicaid expansion.

ANALYSIS

 

This bill requires the commissioner of the department of health and human services to seek a waiver from the Centers for Medicare and Medicaid Services to reduce eligibility for benefits under the New Hampshire health protection program from 138 percent of the poverty level to 100 percent.  This bill also requires the commissioner to develop and implement enhanced eligibility screening procedures.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT relative to the law regarding Medicaid expansion.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

 

1  New Paragraph; New Hampshire Health Protection Program; Waiver Required.  Amend RSA 126-A:5 by inserting after paragraph XXX the following new paragraph:

XXXI.(a)  The commissioner shall seek a waiver to reduce eligibility from 138 percent to 100 percent of the poverty level to receive benefits under paragraphs XXIV-XXV and XXX.  The commissioner shall also include in the waiver a provision ending retroactive eligibility under the New Hampshire health protection program.  Prior to submitting the waiver to CMS, the commissioner shall present the waiver to the governor and the fiscal committee of the general court for approval.

(b)  The commissioner shall develop and implement enhanced eligibility screening to stop payments in a timely manner to those persons who are no longer eligible to receive benefits under paragraphs XXIV-XXV and XXX.  The commissioner shall also establish a method to recapture any payments which were made to ineligible persons.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires the Department of Health and Human Services to seek a federal waiver reducing eligibility for the New Hampshire Health Protection Program (NHHPP) from 138% to 100% of the federal poverty level.  Assuming the waiver is approved, the Department of Health and Human Services projects that roughly 23.5% of those who currently qualify for the program will no longer qualify.  The Department did not provide an estimate of the fiscal impact of this eligibility reduction.  For informational purposes, total program costs were $453.3 million in FY 2017, of which $441.5 million was paid for using federal funds.  The federal share of program costs is currently 95%, and will drop to 94% on January 1, 2018.  As the NHHPP will expire on December 31, 2018 under current law, this fiscal note does not consider any impacts beyond FY 2018.

 

In addition to directing the Department to seek a waiver, the bill requires the commissioner to develop and implement enhanced eligibility screening to stop payments in a timely manner to those no longer eligible.  The Department states that it is unable to determine the amount of any recaptured funds that might result from this provision.

 

The Department of Corrections states that it is unable to determine the bill's fiscal impact, while the Department of Administrative Services expects the bill to have no fiscal impact.  

 

The New Hampshire Municipal Association states that the bill may increase local expenditures by an indeterminable amount, as the NHHPP at the current eligibility level has resulted in reduced local welfare expenditures.
