AN ACT relative to attorney general's duties concerning legislators residing in different districts than they represent.

This bill requires the attorney general to notify the general court when the attorney general discovers a legislator residing in a different district than they represent.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to attorney general's duties concerning legislators residing in different districts than they represent.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Attorney General; Probable Cause.  Amend RSA 14 by inserting after section 29 the following new section:

14:29-a  Attorney General; Probable Cause.  When the attorney general has probable cause to believe that a member of the legislature has ceased to be resident in the district they are representing, the attorney general shall immediately notify the presiding officer, the minority leader, and the clerk of the relevant chamber of such fact.  The attorney general shall not be compelled to provide details of any ongoing criminal investigation beyond the issue of residency.

2  Effective Date.  This act shall take effect 60 days after its passage.

AN ACT relative to attorney general's duties concerning legislators residing in different districts than they represent.

 

FISCAL IMPACT:

The Office of Legislative Budget Assistant is unable to complete a fiscal note for this bill, as introduced, as it is awaiting information from the Department of Justice.  The Department of Justice was initially contacted on 11/13/23 for a fiscal note worksheet, with follow-up contact made on 12/04/23.  When completed, the fiscal note will be forwarded to the House Clerk's Office.
