STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT authorizing friends of animal number plates.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Reference Added.  Amend RSA 6:12, I(b)(43) to read as follows:

(43)  Moneys received by the department of agriculture, markets, and food under RSA 466:9 and RSA 261:97-h, II which shall be credited to the fund established in RSA 466:9, II.

2  Reference Added.  Amend RSA 6:12, I(b)(59) to read as follows:

(59)  Moneys received under RSA 466:4, I(c), RSA 466:6, III, [and] RSA 437-A, and RSA 261:97-h, I which shall be credited to the companion animal neutering fund, established in RSA 437-A:4-a.

3  New Subdivision; Friends of Animals Number Plates.  Amend RSA 261 by inserting after section 97-f the following new subdivision:

Friends of Animals Number Plates

261:97-g  Friends of Animals Number Plates.

I.  The director is hereby authorized to issue special friends of animals number plates, in lieu of other number plates.  The design of these special plates shall be determined as provided in RSA 261:97-i.  The plates shall retain the “live free or die” logo.  Such plates shall be issued only upon application and upon payment of a $30 fee that shall be in addition to the regular motor vehicle registration fee and any other number plate fees otherwise required.

II.  The director is also authorized to issue vanity friends of animals number plates.  The fee for any such vanity friends of animals number plate shall be the fee as provided in RSA 261:97-g, in addition to the fees for vanity plates which are otherwise established by law.  The vanity plate portion of the fee shall be distributed as provided in RSA 261:89 and RSA 263:52.

III.  Of the fees received from the issuance of friends of animals number plates, the department shall retain such amount as is necessary to recover fully the production and administrative costs, as approved by the fiscal committee of the general court.  The amount so retained shall include all costs associated with the set-up of the number plate type, including, but not limited to, system configuration, design, and testing costs.  The remaining funds shall be paid to the state treasurer and distributed as provided in RSA 261:97-h.

IV.  Plates shall be renewed on an annual basis for $30 per set.  Of this sum, the department shall retain an amount as is necessary to recover production and administrative costs as approved by the fiscal committee of the general court.  The remaining funds shall be paid to the state treasurer and distributed as provided in RSA 261:97-h.  The cost of replacement number plates shall be identical to the cost of initial number plates and the revenue from replacement number plates shall be distributed in the same manner as revenue derived from initial number plates.

261:97-h  Distribution of Funds.  The state treasurer shall distribute the funds received pursuant to RSA 261:97-g and RSA 261:97-i as follows:

I.  One-half shall be credited to the companion animal neutering fund, established in RSA 437-A:4-a.

II.  One-half shall be credited to the fund for the operation of the veterinary diagnostic laboratory established in RSA 466:9, II.

261:97-i  Plate Design; Registration.  The commissioner shall:

I.  Determine the plate design and establish a numbering system and method of distribution.

II.  Register the design with the secretary of state.  The commissioner, with the approval of the governor and council, shall have the authority to enter into contractual arrangements for the commercial use of the friends of animals plate design.  Any royalties derived from such contracts shall be paid to the state treasurer and distributed as provided in RSA 261:97-h.

261:97-j  Plate Use.  Plates may be used on passenger motor vehicles and recreation vehicles.

4  Effective Date.  This act shall take effect July 1, 2016.

HB 1567-FN-A- FISCAL NOTE

 

AN ACT authorizing friends of animal number plates.

 

 

FISCAL IMPACT:

The Department of Safety states this bill, as introduced, will increase state restricted revenues by an indeterminable amount in FY 2017 and each year thereafter, increase state restricted expenditures by $293,350 in FY 2017, $7,500 in FY 2018 and each year thereafter, and may increase local expenditures in FY 2017.  There will be no impact on county revenues and expenditures or local revenues.

 

METHODOLOGY:

The Department of Safety states this bill establishes a Friends of Animals license plate, which would be issued and renewed by an annual payment of $30.  The Department states all additional revenues collected from the issuance of these plates, less the Department’s administrative costs and after recovery of production costs, would be distributed one half to the companion animal neutering fund under RSA 437-A:4-a and one half to fund the operation of the veterinary diagnostic lab established in RSA 466:9, II.  The Department is unable to estimate how many Friends of Animals license plates may be issued per year, and therefore cannot estimate the timing or amount of revenue to offset its cost or be distributed to the two purposes identified in the bill.  However, the Department estimates initial costs to establish this new license plate type will be $285,850 in FY 2017 and annual administration costs to be $7,500, beginning in FY 2017.

 

The Department states local governments may also have indeterminable increased expenditures under this bill due to vendor software changes.
