AN ACT relative to instruction for pupils on the issues of HIV, AIDS, and sexually transmitted diseases.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to instruction for pupils on the issues of HIV, AIDS, and sexually transmitted diseases.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 State Board of Education; Review of Curriculum Frameworks and Materials. In accordance with the provisions of RSA 186:11, IX, the state board of education shall:

I. Assess the curriculum frameworks in health, physiology, and hygiene which are being developed by the department of education pursuant to RSA 186:11, IX(a) as they relate to the effects of the human immunodeficiency virus (HIV) and acquired immunodeficiency syndrome (AIDS) and sexually transmitted diseases;

II. Assess all information about HIV and AIDS which has been provided to all public and private schools pursuant to RSA 186:11, IX(b) so that appropriate courses and programs may be offered to pupils;

III. Review all HIV and AIDS curriculum materials as set forth in RSA 186:11, IX(c) to assure the materials are relevant in assisting pupils to become health-literate citizens and lead longer, healthier lives;

IV. Evaluate the information generated in paragraphs I-III as to its effectiveness in reducing the rates and trends of infection, transmission, and sexual conduct over the last 10 years in New Hampshire, and compare such information to the curriculum frameworks information and materials provided to pupils in kindergarten through grade 12 in other states with the lowest rates and trends of infection, transmission, and sexual conduct.

2 Review of State Board of Education Findings. The state board shall present written findings of the assessment, review, and evaluation required under section 1 of this act to the house and senate education committees for review no later than May 1, 2012. The house and senate education committees may propose appropriate legislation.

3 Effective Date. This act shall take effect upon its passage.
