AN ACT relative to the termination of parental rights in cases where the child is born of rape.

This bill provides that the court shall terminate the parental rights of the father in cases where the father has pled guilty to or is convicted of rape of the birth mother.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the termination of parental rights in cases where the child is born of rape.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Termination of the Parent-Child Relationship in Cases of Felonious Sexual Assault. Amend RSA 170-C by inserting after section 5 the following new section:

170-C:5-a Termination of the Parent-Child Relationship in Cases of Felonious Sexual Assault. A petition for termination of the parent-child relationship of the father shall be granted in cases where the child’s birth is the result of rape by the child’s father and the father has pled guilty to, or is convicted of, felonious sexual assault of the birth mother. A conviction or plea under RSA 632-A:2 or 632-A:3 shall be conclusive evidence supporting the termination of the biological father’s parental rights.

2 Effective Date. This act shall take effect January 1, 2013.
