A BILL TO BE ENTITLED
AN ACT to require the approval of the board of commissioners of davidson county AND the approval of the voters of the area to be annexed in a referendum before a city not primarily located within davidson county may annex any territory within davidson county.
The General Assembly of North Carolina enacts:
SECTION 1. No city not primarily located within the territory of Davidson County may adopt an annexation ordinance under any of the provisions of Article 4A of Chapter 160A of the General Statutes that applies to any territory located within Davidson County unless both (i) the Board of Commissioners of Davidson County has, prior to the adoption of the annexation ordinance, approved a resolution consenting to that annexation and (ii) the voters of the area to be annexed have approved the annexation in a referendum. A public hearing on the resolution must be held by the board of commissioners at least seven days before any action may be taken on it.
SECTION 2. This act is effective when it becomes law and applies with respect to any annexation ordinance adopted after that date.
