A BILL TO BE ENTITLED

AN ACT to allow the department of insurance to enforce certain provisions of the public health service act by requiring insurance companies to comply with those provisions within this state.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 3 of Chapter 58 of the General Statutes is amended by adding a new section to read as follows:

"§ 58‑3‑300.  Health insurance issuers subject to certain requirements of federal law.

Pursuant to the authority granted to the states under 42 U.S.C. § 300gg-22(a)(1), health insurance issuers that issue, sell, renew, or offer health benefit plans, as defined in G.S. 58‑3‑167(a)(1), in the State in the individual or group market shall meet the requirements of Part A of Subchapter XXV of Chapter 6A of Title 42 of the United States Code and regulations issued thereunder."

SECTION 2.  Notwithstanding the effective date of Section 1 of this act, the Commissioner of Insurance may, prior to January 1, 2014, enforce the requirements of G.S. 58‑3‑300 upon health insurance issuers for policies that would have starting or renewal coverage dates on or after January 1, 2014.

SECTION 3.  Section 1 of this act becomes effective January 1, 2014. The remainder of this act is effective when it becomes law.
