A BILL TO BE ENTITLED
AN ACT to require a motor vehicle dealer to provide a prospective purchaser of a used motor vehicle with a used vehicle history report prior to selling or agreeing to sell the vehicle.
The General Assembly of North Carolina enacts:
SECTION 1. Article 12 of Chapter 20 of the General Statutes is amended by adding a new section to read:
"§ 20‑308.3. Provision of used vehicle history report to prospective purchaser of used motor vehicle.
(a) Vehicle History Report Required Prior to Sale. – A motor vehicle dealer shall not sell or agree to sell a used motor vehicle until the motor vehicle dealer has provided the prospective purchaser with a used vehicle history report for the car to be sold.
(b) Definition. – For purposes of this section, the term "used vehicle history report" means a report that sets forth available information about the vehicle's past owners, servicing history, accident and damage history, and other information that may be relevant to a prospective purchaser.
(c) Cost of Report. – A motor vehicle dealer shall not charge a potential purchaser for the cost of obtaining or providing a used vehicle history report to the potential purchaser."
SECTION 2. This act becomes effective October 1, 2013.
